Welcome to InKeepsakes. These Terms of Service ("Terms") govern your access to and use of our website, products, and services. By visiting our website or placing an order, you agree to these Terms.
If you do not agree with these Terms, please do not use our website or purchase our products.
1. About InKeepsakes
InKeepsakes creates handcrafted custom keepsakes using customer-submitted tattoo artwork and other approved designs.
Because each product is personalized, our products are made specifically for each customer and are subject to the policies described below.
2. Eligibility
By placing an order, you represent that:
- You are at least 18 years old, or have the consent of a parent or legal guardian.
- You have the legal right to purchase our products.
- The information you provide is accurate and complete.
3. Custom Artwork
By uploading artwork to InKeepsakes, you represent that:
- You own the artwork, or
- You have permission from the tattoo artist and/or copyright owner to use it.
You grant InKeepsakes a limited, non-exclusive license to use your submitted artwork solely for:
- Producing your custom keepsake
- Communicating with you about your order
- Quality control
We do not claim ownership of your artwork.
4. Artist Recognition
When requested by the customer or participating artist, we may recognize the original tattoo artist within our packaging, marketing, or Legacy Archive™.
Artist recognition does not transfer ownership or copyright of the artwork.
5. Customer Content
Customers remain responsible for the content they upload.
You agree not to submit artwork that:
- Infringes another person's intellectual property rights
- Violates applicable laws
- Contains unlawful or defamatory material
- Contains malicious software or files
We reserve the right to refuse any order that violates these Terms or applicable law.
6. Orders
All orders are subject to acceptance.
We reserve the right to:
- Refuse any order
- Cancel an order before production begins
- Request additional information before accepting an order
If an order cannot be fulfilled, any payment received will be refunded.
7. Pricing
Prices are listed in U.S. Dollars.
We reserve the right to change pricing at any time without notice.
Price changes do not affect orders already accepted.
8. Payments
Payment is required before production begins.
Accepted payment methods are displayed during checkout.
Orders remain pending until payment has been successfully processed.
9. Production Time
Production times shown on our website are estimates.
Actual completion times may vary depending on:
- Order volume
- Product availability
- Artwork revisions
- Holidays
- Shipping carrier delays
We will make reasonable efforts to keep customers informed of significant delays.
10. Shipping
Risk of loss transfers to the customer upon delivery to the shipping carrier, subject to applicable consumer protection laws.
Shipping estimates are provided by third-party carriers and are not guaranteed.
11. Returns & Refunds
Please refer to our Refund Policy for complete information regarding returns, replacements, cancellations, and refunds.
Because our products are custom-made, most orders are not eligible for return unless they arrive damaged, defective, or incorrect due to our error.
12. Intellectual Property
All website content, including but not limited to:
- Logos
- Product photography
- Website design
- Written content
- Graphics
- Branding
is the property of InKeepsakes unless otherwise noted.
No content may be copied, reproduced, or used without written permission.
13. Legacy Archive™ & Customer Stories
With your permission, we may feature your completed keepsake, photographs, and story in our Legacy Archive™, social media, marketing materials, or website.
We will never publish your personal story without your consent.
You may request removal of your story from future marketing by contacting us.
14. Limitation of Liability
To the fullest extent permitted by law, InKeepsakes shall not be liable for:
- Indirect damages
- Incidental damages
- Consequential damages
- Lost profits
- Emotional distress arising from the use of our products or website
Our maximum liability shall not exceed the amount paid for the applicable order.
Nothing in these Terms limits rights that cannot be waived under applicable law.
15. Disclaimer
Our products are decorative and functional keepsakes.
Customers are responsible for following all care instructions provided with their purchase.
Normal wear and tear is not considered a manufacturing defect.
16. Privacy
Your use of our website is also governed by our Privacy Policy.
We respect your privacy and strive to protect your personal information.
17. Governing Law
These Terms shall be governed by the laws of the State of Texas, without regard to its conflict-of-law principles.
Any legal disputes shall be brought in the appropriate state or federal court located in Montgomery County, Texas, unless otherwise required by applicable law.

The most current version will always be posted on our website with the updated effective date.
